1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website fusionarchitect.pro and the business continuity financial planning services provided by FusionArchitect d.o.o., a company registered in Croatia with registration number 952387416 ("FusionArchitect", "we", "our", or "us").

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

These Terms constitute a legally binding agreement between you and FusionArchitect. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Description of Services

FusionArchitect provides business continuity financial planning services, including but not limited to:

• Risk assessment and analysis
• Strategic financial planning
• Compliance management and regulatory guidance
• Crisis management and recovery planning
• Business advisory services

All services are provided in accordance with Croatian and European Union laws and regulations. The specific terms of each service engagement will be outlined in separate service agreements.

3. User Obligations

When using our website and services, you agree to:

5. Payment Terms

Payment terms for our services will be specified in individual service agreements. Generally:

• Fees are due according to the payment schedule outlined in your service agreement
• Late payments may incur additional charges as specified in your agreement
• All fees are exclusive of applicable taxes unless otherwise stated
• Refund policies are outlined in individual service agreements

6. Intellectual Property

All content on our website and in our materials, including but not limited to text, graphics, logos, images, software, and methodologies, is the property of FusionArchitect or its licensors and is protected by Croatian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our intellectual property without our express written permission. Any unauthorised use of our intellectual property may result in legal action.

Reports and recommendations prepared specifically for your business remain your property, but the underlying methodologies and frameworks remain the intellectual property of FusionArchitect.

7. Confidentiality

FusionArchitect acknowledges that in the course of providing services, we may have access to confidential and proprietary information about your business. We agree to:

• Maintain strict confidentiality of all client information
• Use client information only for the purpose of providing agreed services
• Implement appropriate security measures to protect confidential information
• Not disclose client information to third parties without written consent

This confidentiality obligation survives the termination of our service relationship.

8. Limitation of Liability

To the maximum extent permitted by Croatian law, FusionArchitect's liability for any claims arising from or related to our services is limited to the total fees paid by you for the specific services giving rise to the claim.

FusionArchitect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

We do not warrant that our services will be uninterrupted, error-free, or that they will meet your specific requirements. Our services are provided "as is" and "as available".

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless FusionArchitect, its officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your use of our services in violation of these Terms
• Your violation of any applicable laws or regulations
• Any inaccurate or misleading information you provide to us
• Your business decisions based on our recommendations

10. Termination

Either party may terminate the service relationship at any time with written notice. Termination terms specific to each service will be outlined in individual service agreements.

Upon termination:

• All outstanding fees become immediately due and payable
• We will provide any completed work products
• Confidentiality obligations continue to apply
• Both parties will return or destroy confidential information as requested

FusionArchitect reserves the right to suspend or terminate services immediately if you breach these Terms or fail to make required payments.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Croatia.

If you are a consumer within the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

We will attempt to resolve any disputes through good faith negotiations before resorting to formal legal proceedings.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.

13. Entire Agreement

These Terms, together with our Privacy Policy and any individual service agreements, constitute the entire agreement between you and FusionArchitect regarding the use of our website and services.

No waiver of any provision of these Terms shall be deemed a waiver of any other provision or of the same provision on a future occasion.
